You must be running an old version as I just downloaded the files and the code looks different to what you are posting.

As a test make it echo

"UPDATE ".$this->table['daily']." SET visitors=visitors+'1' WHERE day = now()"

to see what code it is creating.
So have you fixed it?
I've been on a course for six weeks for my new job. I will do it when I get chance.
Errrr you have captcha enabled. I certainly see it when I go to sign.
I'll walk through the JS when I get a minute.
It's a bug I reported a long time ago. If you refresh the page the captcha then appears. Without trawling through all the JavaScript I couldn't say for sure what is causing it.
I'm guessing it is from different ips all the time?
It's a guestbook. It doesn't have members. You can delete posts via the admin.
I couldn't say 100% but yes to replacing everything except config.inc.php

The post it's self is rubbish. They are either just trying to boost the websites search engine ranking or just hoping that the more places they have a link the more chance of people visiting.

A quick look at this sites own guestbook shows that the captcha isn't working.
Now the question is will your guests understand the captcha
Try reuploading the files and checking their permissions.
I'm pretty sure the law only applies to tracking cookies and even then only on major sites. I wouldn't worry about it to much for now.
